Arrest of Anti-Smoking Campaigner @ Football Assosciation Soho Square

Friday 14-12-07. Arrest of Anti-Smoking Campaigner @ Football Ass. Soho Square- 14:10 pm for B.O.P. & 17:45 for B.O.P. (Later changed to Disorderly conduct Harassment Alarm & Distress)

At approx. 1:30 pm. I stood on a Soap Box with a sign saying “FREEDOM OF SPEECH – ARTICLE 10 E.C.H.R. Anybody may speak on this soapbox for 3 minutes.” I had placed it next to the F.A. building approx 3 meters from the entrance.

I introduced myself “My name is Stuart Holmes I have been named as the U.K.s leading anti smoking campaigner”I was addressing a large number of the worlds press and members of the public who were awaiting an announcement that Fabio Capello had been appointed as England’s new football manager. I was displaying a sign saying ACTORS SMOKING and was reading from a file of papers headlined-

ACTORS SMOKING WILL CAUSE ONE BILLION DEATHS THIS CENTURY - CHILDREN ARE THE TARGET - NEED PUBLIC ENQUIRY- Extracts from bundles - Judicial Review against the - Attorney General – Tessa Jowell & the Met. Police Commissioner CO/8239/06

I continued to speak- “The World Health Organisation forecast that one thousand million people (1 Bn. people) will be killed by tobacco addiction this century-that figure is so large it works out to be more than 15 times greater than the total war dead of the entire 20th century (excluding genocide) they will be killed due to a consumer product sold in children’s sweet shops.

90% of smokers become addicted when impressionable children, the main reason why children start to smoke are actors smoking in films! There is a moral obligation to protect children, at the church next door there is a campaign “A child is born.” I would like to invite anybody to speak on this soapbox for 3 minutes.”

An Italian lady -Clair from the Church next door -St Patrick's then spoke for 10 minutes regarding her experience with smoking, I then returned and spoke about the main cause of the tobacco holocaust being due to political corruption and corporate crime.

Corrupt legislation- the 2002 Tobacco Advertising & Promotion Act, the 2006 Health Act, Rupert Murdoch being a director of Marlboro cigarettes and broadcasting over 450 films a week 80% promoting smoking, Tony Blair’s involvement with Rupert Murdoch and the Bernie Eccleston affair, Sylvio Berlusconi affair, Tessa Jowell, David Mills, Sir Igor Judge's hypocrisy, Judge Hon. Calvert Smith's conflict of interest via Dame Barbara Mills (ex head of DPP. & S.F.O. Sister of David Mills the husband of Tessa Jowell & Calvert Smiths predecessor), Directive 98/43/EC.

I was inviting anybody to speak on the soapbox- later one man spoke about the warnings on packets and freedom of choice. At approx 2:00pm. Police officers entered the F.A. A few minutes later PC. CD471 accompanied by a male from the F.A. Informed me I was on private property, I replied its not obvious, (other people were stood next to me) I asked the F.A. male why he had not complained, he said he'd thought he would leave it to the police.

The officer took hold of me forcing me to move, I moved 1 meter then stood on the box, he then said I was causing an obstruction and pulled me from the box, I fell awkwardly stating I was operating under article 10 of the ECHR. He then inflicted great pain via the handcuffs on my wrist bone (see doctors report) I asked if I had been arrested and he said yes, what for? A breach of the peace, I protested there was no breach of the peace, and continued with brief smoking statistics. (Deaths)

I was detained at the police station for several hours then released without charge, I returned to the F.A. At approx 5.00pm. Standing on the soapbox positioned to cause least obstruction at the end of the ramp and displaying the ACTORS SMOKING sign again quoting from the file, I also displayed the Signe for 10 seconds or so by the side of Adrian Bevington (F.A. Dir. of communications) at the end of his presentation to the press, who took pictures, I asked Mr. Bevington to continue but he declined.

At approx 17:40 several police vehicles arrived with sirens blazing, a PC & WPC asked could they speak to me I said yes, the PC said that I was being disruptive I turned to the assembled press and asked if I was being disruptive and they replied yes. A member of the press then said he was finding it difficult to work while I was speaking on the soapbox.

PC 746 then pulled me from the box pushed my head against a glass window and imobilised me in an arm lock, I asked if I had been arrested he said yes for a B.O.P. I spoke in a loud voice, there was no B.O.P. And asked the public to phone my solicitor, was handcuffed and put in van, I asked the officers in the van do you have my papers, my file and soapbox? The officer replied the other car has taken them, to date the file has not been returned.

At the police station -West end, Saville Row. I was charged with “Disorderly Conduct that was going to cause H.A.D.” I refused the bail conditions, was kept over night and next day transported to Westminster Magistrates Court, where I was unconditionally bailed to appear at 185 Marylebone Rd Court, on 4-3-08 at 2:00pm. released approx 3:00 pm.
